Implicit consent is inferred through actions or behaviors rather than being explicitly communicated. This means that consent is established through a person's conduct or circumstances, which suggests agreement to a particular use of their data. For example, if someone willingly provides their email address to receive a newsletter, the act of signing up can be seen as giving implicit consent for that use.

In contrast, explicit consent requires clear and direct agreement, often documented through a signed form or a clear affirmative statement. This distinction is crucial in privacy regulations, as different types of consent may have varying legal implications and requirements for compliance.

Understanding this difference is essential for organizations that handle personal data, as it directly impacts their compliance with privacy laws and how they develop their data handling practices. Therefore, recognizing that implicit consent is based on inferred agreement through actions clarifies its application in privacy contexts.
